As soon as he vacates, take a picture of everything that is damaged, preferably with that day's newspaper in the picture to validate the day the pictures were taken. Also, if you have access, video tape as well. Somethings don't show up as well in pictures. Then follow the advice the previous poster gave you about the settlement letter and investigating if you are allowed to deduct back rent from the SD.

Hi Thanks for your comments. This is tricky to say the least and he clearly is hiding behind the law. He's trying to have it both ways - I send the SD back without an inspection of the property or he just stays and continues to not pay. I guess another question is do I take him at his word to leave on March 1, then if he doesn't, change the locks back to something I have a key to? As I said, he changed the locks in violation.
