The laws vary depending on where you are, but the rule of thumb I hear from "Ask the Attorney" is your best bet is to hold it for 30 days.
Send notice to tenant that you are holding it and if you do not hear from them it gets dumped. If you don't know where tenant is, send certified to "last known address", your rental and if it is not forwarded, at least you have proof that you tried.
