by law can a landlord serve a tenant with an eviction the same day payment is expected for non payment of late fees/damages if rent is paid for the month

If the tenant is already in default for "for non payment of late fees/damages", yes.

What do you mean by "serve a tenant with an eviction"

You serve the 3 day notice.
You cannot serve the notice for the eviction proceeding in court.. this must be done by process server.
You can serve the notice of the 'writ of possession'...meaning the court has ordered the eviction...
usually this is done by a marshal or sheriff because they are being removed.

So.. huh? what do you mean?
