A tough call- Arrest during Eviction process by Paul (IL) on February 23, 2012 @17:21

                              
I started the eviction process with my current renter, and as I learn more about him, i know he has a warrent in other state. If I "tip" him and get him arrested, will this delay my current eviction? Will his wife gets the right to stay longer? (even i put her name on the eviction case as well)

I doubt it will speed things up or delay them as the wife can still appear in court to appeal. if she is a no show, its as with both are a no show. his being in jail doesnt strengthen their case to stay. and i sure hope you DID put her name on the paperwork. let your conscious be your guide...

The fact he is in jail should matter one bit. His being incarcerated gives his wife no special legal rights.

I have had several people arrested already after finding about warrants. Not my teannts. Do it. The eviction process will not delay one bit.

I would tip him, he is running from an obligation in another state. Eviction is a totally separate process, in the court system of my state. You can continue with the eviction, his wife can show up for the eviction if he is detained elsewhere, for whatever reason.
No, the wife does not get to stay longer, at least not in my state. But my state is landlord friendly. No pay, the court system says you do not stay.

Are you allowed to warn him that if you evict then the police will find out about his warrant, so maybe they will give you notice and leave on their own?
