Tenant won't leave and has not signed a lease

Sixteen months ago I allowed my brother to move in with me and has not paid any rent while he's been here. I have since written him a letter asking him to move out after my ill father moved in and is causing stress to my father but he will not leave. Do I have to go through the court to get him evicted if he recieves mail (including state unemployment checks) at my house?

Ask you brother if he wants the permanent (yes, permanent) stamp of an eviction on his credit report. That means he will never be able to rent again, buy a car or whatever else requires even the most mediocre of credit scores. Give him a firm move out date and make it soon. Then file for an eviction if he is not out by that date and not two minutes later.
