It is a basement? For sure you are renting an illegal apartment. Call the city, the power company and the health department. Stop paying rent now. You do not need a lawyer. Take your landlord to court and get triple your rent already paid. Your landlord is a double barrel idiot.

It was all in the lease and things are just different on Long island. This is a Leagal apartment within a house. We signed papers. Its all a binding contract document. We pay 25% of the utilities.

It is legal? Do you have a separate entrance? Are there low windows that you could exit from in case of a fire? Are there two entrances? Is the neighborhood zoned for multi-unit housing? It does not matter how many papers you signed. They are not binding on an illegal apartment. The utility arrangement and the hot water hookup by itself is enough to make the apartment illegal. You can not be evicted from an illegal apartment. Call the city, the power company and the health department to report your landlord.

I definitely wouldn't assume the place is legal for your landlord to rent out, unless you've verified that with the city. A landlord having you sign papers doesn't indicate that the place is legal or not. My former landlord had me sign a lease on his illegal apt. Long story short, habitability problems arose, he wouldn't fix them, I quit paying rent, he sued me for the rent - and he lost because, as the TV judges always say, you cannot be awarded money for illegal activities! So check with the city (if you haven't already done so); if the place is illegal, that lease is illegal. It would be like signing a contract with someone to be paid X amount for 10 grams of heroin, and then suing the buyer when they refuse to pay you. Courts don't help people collect from their illegal activities. And FYI, if the place is illegal, that is on your LANDLORD and will not hurt you in any way whatsoever. Even if a tenant knowingly moves into an illegal apt., courts don't care. They only care that the landlord rented the place out to begin with.

I’ve been a landlord, with my own 20 properties, for the past 5 years now.I’ve decided not to subscribe to the tenant’s deposit scheme but to take 2 or 3 months rent in advance, which is clearly worded in my ast contracts.My reasons are:I need the working capital – i.e. I need the money sitting in my bank and not the deposit scheme.You may argue that I would be exposed when the tenant comes to leave and their last month (or 2 momths) are free of rent, having paid in advance on day 1 – however what Ive found is:1. Those tenants that paid their rent on time also looked after the property and left it in a good state.and2. Those tenants that did not pay on time – well, I had their deposit in my bank assisting my cash flow when they did not pay – and if they damaged my property then I was covered by malicious damage insurance – the deposit left by a bad tenant would be swallowed up by missed rent and not go anyway to paying for the damage.The biggest exposure for a landlord is not being paid – so I advice that you take out rent insurance for the 1st 6 months – after which section 21 can be used to evict on an accelerated procedure with no need to go to court.
