Are you sure this is a summons for small claims court and not for for an eviction proceedings? Were you given a 3 day pay or quit notice? If not then this is not an eviction. They must follow proper procedures. If it is small claims court and they did not file eviction papers against you then they are doing this all wrong. Come up with the rent prior to court and maybe you can stay if they do not serve you with 30 day move notice.

That's right. Just ignore the summons and stay right there. After all, you have not paid rent for months. What could happen?
