I own my own house and my friend and his girlfriend moved in 5 months ago. I'd like them to move out but dont know how to go about doing it. They didnt sign a lease with me. My friends girlfriend is a lazy pos who is trashing my house please help me. Is asking them to leave in seven days in illinois to short?

Are they paying you rent? If yes then you have to follow the proper procedures. If they are current with the rent you have to give the 30 days notice to move. If they are behind you can give them a p&q notice and when they don't pay up file for eviction. You can at the same time give them a 30 day notice to move as well. You can try telling them to leave in 7 days but legally you can't force the issue.

At best you have a tenancy at sufferance, at worst you have a tenancy at will. The difference being not having an agreement and having an agreement, respectively.

In either case, you must serve proper written notice of termination IAW your state's LL/T law (found in the links to right). If the T doesn't leave, then you must go through the legal eviction procedures for holdover IAW with your your state's LL/T law.
