Wall painted
by Pre inspection deficiencies (California)

My wife asked to paint an accent wall durring her stay in a rental. The Land lord agreed. The land lord did not say prior to moving out, that the wall would have to be repainted. My wife requested a pre-inspection prior to move out. Deficiencies were listed, and corrected, however the wall was never brought up. IAW this site, any deficiecncies found needed to be brought up, and those that were not found could not be used out of the initial security deposit unless the occured after the pre-inspection.
I would like to know what steps are necessary in order to protect my Wife's security deposit. The wall was never said to be repainted, and durring the pre-inspection, it was never brought up. It was only brought up after my Wife vacated the premises and the lease was over. Please, any help would be appreciated

Before you try to fight the issue with the painted wall, check your wife's lease. There more than likely is a clause regarding painting, or returning the unit to original condition. I do not allow tenants to paint. Was the request for painting made to the landlord in writing? A pre move out inspection does not negate the Landlord assessing damages after the move out. One cannot see everything till the unit is empty. The landlord must provide an itemized list of the "deficiencies" and return the remainder of the Security Deposit within 21 days of return of the premises; including copies of the receipts for the damages reclamated.

What you have got is one of those purse snatching landlords. He could not find anything wrong at move out but still grabbed as much of your deposit he could on the way out. It is wrong for landlords to let tenants believe everything is OK and then look to something buried in the lease to pick your pocket. You can take the landlord to small claims if it is worth the time and money. What color was the wall anyway?
