Jake is giving you good advise... you need to post the 3 day and mail it. (certified)....'nail and mail'.
On day 4...go to court and file.
You can allow the tenant to pay you anytime up to getting the court ordered writ of possession. So..if tenant is telling the truth..you get your rent and tenant knows that you will follow through. If you don't get the rent..you didn't let the tenant get away with another month of free rent.
PS.. including the cost of filing the paper work with the court... (in NY that costs me $110)
