about evicting tenant

I need to evict a tenant that lives upstairs can she go to townhall and have me fined for illegal apartment? As her best friend works in a law firm and might be advising her as what to do. As I found out she was being advised by her friend when she took her boyfriend to court for custody of her son and her friend pushed her to do so. I have a feeling she will destroy apt. is it a good idea to take some pictures before it happens? Is it always a good idea to rent with lease? Can she damage apt and say I did it? as she burned stove a couple months ago and I had to buy a new one Also she blew lights and had to get an electrician to fix it.

Need more information like what state are you in? City? What type of lease? Why would she destroy the apt? Did you do something to make her mad at you? Did you not take pictures of the apt before renting it ti her? Have you given a non renewal notice? More info please!!!!

Is the apartment illegal? The catch 22 is that if it is illegal and she reports it, you will be fined but they will also almost always make her move right away as well.
You should always have a lease or agreement in writing. It outlines the rules, procedures, rent, responsibilities and consequences for each party.
You should have had pictures beforehand. Also, a lease and move in inspection would have established that everything was in order.
If there isn't an agreement in place, then you automatically have a month to month agreement. Check with your state's regulations regarding giving notice to vacate. Most states have a 30 day or 1 term, notice requirement.

Evict her by following legal procedures for your state and then be sure you do NOT have an illegal apartment. If you DO have an illegal apartment, take steps to make it legal.
Do an inspection and take photos. Did you take photos before the tenant moved in upstairs? If not, definitely do an inspection (with proper legal notice) and take another person with you and take pictures.
