Your tenant is taking you for a fool.
Find out the law for your State and start the eviction process now. I looked it up and lucky you, no notice is required!
Because the tenant has a lawyer involved I would proceed with the eviction without delay.
The longer you wait the more time he gets to live for free on your dime

Read your lease and google landlord tenant laws in your state. In most states when a tenant breaches a term of the lease, other than non payment of rent, the landlord must give your written notice of the breach and give you time to correct the problem. Then, if don’t, they must file for eviction. Unless the 60 days coincides with the end of your lease they cant terminate the lease without following the law.
