yes, the plan with the next tenant is to have the unit a non-smoking rental, which will be in the lease. The building common areas are non-smoking, but unit owners are allowed to smoke in their individual units. How do you recommend dealing with this situation for the remaining months? We can't go on bothering the tenants upstairs, but I can't imagine an eviction process would happen much faster and would certainly be a lot more work....

well, simple : as you said, the common areas only are non-smoking : so, you just have to recommend your Tenants NOT to smoke on their balcony, nor in the building entrance, and other common areas. Let them smoke in the unit they are renting from you.
I am not sure I will go to court for only three month before the end of the lease.

If the unit smells so bad from the smoke that it's disturbing the neighbors, expect to have to do a fall carpet replacement and repainting in order for it to be rentable to a nonsmoker.
