Most CC&R's have a clause about 'Nuisance' which your tenant is causing the neighbor. You as the owner are liable and could be held legally responsible for your tenants smoking under nuisance laws. The Condo Board can take action against you as can your neighbor. If you wait another three months, your neighbor and the Board might take action sooner against you. All the neighbors in the Condo will soon know that you have no regard to their health or safety. They will soon turn against you for not taking responsibility and correcting this asap. There are many 'Smoke free' organizations in Oregon State that will give advice to the neighbors on how to bring suit against you.
