Here is a situation. I rented the apt the next day after the lease expires. Now the tenant is not paying rent and not moving (eviction proceedings started) The future tenant signed lease and has ended occupancy of his current apt, which will be occupided by other tenants on said date.
Now here is a dilemma, what do we do if the tenant from my unit does not leave on time? The lease currently gives me 30 days to give occupancy, but... I am at a loss as nothing like this ever happened to me. what has been an experience out there? Do you pay for the hotel of your new tenants?

This is why I never rent a place out until it is vacant and I have completed all repairs and upgrades. You can put him up in a hotel at your expense if you really want to or you can exercise the happy clause.

Send the old tenant the "Urgent Late Notice - Eviction Status Strong Version".

Let them know that their credit will be destroyed and the eviction will be on their record FOREVER.

If the new lease gives you 30 days to give the new tenant occupancy of the rental, then no, you do not have to put the tenant up elsewhere meanwhile. When the tenant signed the lease with the 30-day clause, the tenant agreed to the risk that the rental would not be provided for 30 days. It is his risk and his expense.

I would not provide a hotel until the 30 days are up. If it appears it will go on longer than that to get the old tenant out I would probably offer the new tenant the opportunity to back out and get any money they put down on the place.
