Did you have a separate lease for each tenant? Or, is it one lease and you are receiving two payments. Either way, it is not a good practice. Next time, have one lease and accept only one payment. When the bad paying tenant moves out, will you continue to lease at half the rent? Why have you allowed one tenant to live free for the past 4 months?

One lease with both names on it. I receive 2 payments. I am not going to continue leasing after lease is up. I haven't allowed 4 months free, it is December and March.

    How did you collect rent for January and February without collecting for December? When is the lease up?

      I have tried really hard to get December but he says my bank is the problem. Went to my bank and checked my accounts (I knew he was lying) told him he needs to show proof he paid. He ignores me and says he is filing bankruptsy. He mailed his check for January and February, both were late. The lease is up in July this year. I just don't know what to do. If I file for eviction he may already be gone??? Doesn't make sense to do that. He is into the other tenant for utilities etc.
