That reply intuitively makes sense to me, but the lease I feel is a little unclear. Why stipulate (item 31) that the tenant "is responsible for liability/fire insurance coverage on the premises". Are we saying if the house burns down, he pays for it, but if it floods and is washed away, the landlord pays for it? It might help if the scope of "renter's Insurance" (what it does and does not cover) was expanded upon in the lease?

Renters Insurance does not cover the landlords property. Thats why the landlord should have proper coverage for the rental property. Why isn't your Insurance company handling this for you? Why are you trying to make the tenant responsible for your rental property? The tenant is only responsible for damages caused by the tenant.

Mary, READ my posts. I'm not trying to "make the tenant responsible". I'm trying to figure out according to the lease WHO is responsible for WHAT. And I think I understand it much better now, thanks to other helpful input.

According to my insurance agent (your's could have answered this also) Renter's Insurance does not typically include Liability/Fire coverage. However it is SO cheap that my agent includes both in a Renter's policy as a normal course.
The Fire portion only covers the T's property in the case of a fire, not the structure. The same would hold true if they had Flood coverage.
So it is your responsibility to fix the structure.
BTW, in most state's you are not liable to pay for a hotel, only prorate the rent. The T's insurance should cover any other costs. Although I must wonder it would in this case because flood coverage is not a normal part of Renter's Insurance. I guess it really doesn't matter, it is the T's responsibility to insure themselves.

Bryan, that's interesting. Because he says his insurers are denying all his claims on account of the fact that it is a "body of water". That gels with what you are wondering.
I see what you're saying about the FIRE portion only covering the tenant's property, not the structure. Now the lease makes much more sense. Still could maybe be further clarified, but i get what they are after.
