Tenants haven't paid rent after non-Renewal served by Anonymous on March 16, 2012 @15:08

                              
On Feb. 29, I served the 60-days notice of Non-Renewal of Lease to tenants. Now they haven't paid rent for this month. They acknowledged receipt of the non-renewal notice. They are not answering my ph calls and txt msgs. regarding of when they will pay the rent for March. Last nite they sent me a txt that they will be out of the property at the end of this month, no mention of rent owed. Is there a Form that I should send them where they confirm in writing the exact date of their move-out? I worry that, they are not going to vacate the house on 3/31, and they will use the sec. deposit to pay March (even though the lease states not to use sec. deposit to pay rent), and leave the house with damages that I won't be able to collect. I know that I will have to make an inspection w/them before they leave. Pls. advice. Thanks.

Start eviction proceedings for not paying rent. Send them the LPA letter that advises them the ramifications to their credit if you take them to court for back rent and eviction.

Immediately nail/mail the p/q notice IAW your state law. At the end of the notice period, file the eviction suit. If you allow the tenant to stay at your property rent-free for March with no ramifications, what makes you think they will really ever move? They'll ride that gravy train to the bitter end! By the time you realize what has happened to you, you'll be in July and out thousands of dollars in rent!

To the last poster - no need to be rude to someone who comes to these boards needing info and attempting to learn how to be a good landlord. Many people end up in this business because they couldn't sell their house and had to rent it. Take the advice of the other posters and please read these forums as they are packed with a lot of info.
