Re: Domestic issue by Sara (Fl) on March 18, 2012 @11:16

In Florida, the penalty for prematurely locking a resident out is the resident’s actual damages, with the minimum damages being an amount equal to three months’ rent. An additional three-month rent penalty applies if the landlord prematurely disposes of the resident’s personal property, even if the personal property involved is apparently of little value. In addition to his actual or the statutory minimum damages, whichever is greater, the resident is entitled to his court costs and attorney’s fees. Finally, the landlord may face a claim for civil theft and possibly criminal charges.

Nothing premature in this case. The daughter and family have moved. They have refused to return the keys.

"they left a lot of their goods here, have kept the key and say they will come back whenever they feel like and get the rest" They have not surrendered the property as they have gave notice that they will return. The landlord should post to enter and then record conditions and if no one returns under Florida law in 15 days, claim as abandon property and dispose of anything remaining according to law.

How would they post a notice to enter their own residence? Daughter and family were a guest of the parents. Daughter & family gave no notice, just told them they will come and go as they they please.
