Eviction

How long do I have to wait before I need to get a court order to have my tenants evicted for lack of payment? We heard that the couple split up and when I go by the house no one is ever home. We call and they have our phones blocked from incoming calls and they won't text us back when we try to text them.

I'm from California and not familiar with Texas state real estate laws. In CA we have to serve a 3-day pay or quit notice and on the 4th day we can start the eviction process. From your post, it sounds like the tenants have already moved. If that is the case, you are lucky. Check your state law for your next move.

As soon as they are late with the rent. Hang and mail the pay or quit notice. Start eviction.

You begin the eviction process the day after the rent is due (NOT after the late fee kicks in, but the day after the rent is DUE) -- if the rent is due on the 1st, you begin the process on the 2nd, usually by providing tenant with a pay or quit notice IAW your state law. Be sure to look up your state law using the links to the right or google "[your state] landlord tenant act".

Section 24.005(a) of the Texas property code requires at least a 3 day notice to be served to the tenant before filing an eviction suit, unless your contract states a longer or shorter period. I send out the notice the day after rent is due. In my case, rent is due on the first, so I send the notice on the second day certified with a return reciept and I post it on their door as well.

It's funny how tenants often think they can avoid eviction, etc. by not being available when the landlord shows up or calls. I don't know the laws of Texas but most states allow you to post the notice in a conspicuous place after you've attempted (and failed) at personal delivery. Check your statutes for how many times you have to try first...but it sounds like you already have.
