One of the CA LLs will be along shortly to offer a state-specific response. Meanwhile, generally, you can ask anyone anything, but you may have to sweeten the pot to encourage the tenant to move at your request. You can determine the cost of not moving into the property and then, if warranted, you might want to offer the tenant an amount equal to their moving costs, or full return of their SD despite the condition of the rental, or something like that if it makes sense based on what you will spend staying somewhere else for the duration of the existing lease.

Thank you! I might see if she will accept $1000 in addition to a full return of her SD, and tell her she does not need to clean it... she is a bit high maintenance, so she might not necessarily go for it, but it's worth a try.
