So your tenant has not signed a renewal of his lease. Therefore, he is continuing to rent M2M by holdover if his old lease is expired. You should post a cure or quit notice for the lock issue and have him either replace the old locks or provide you with entry code (if you are willing to allow the breach). Also post a cure or quit notice for the unpaid water bill. Essentially, when you receive money from a tenant, the money goes toward the oldest charge on the tenant's account first. So if tenant owes for February water charges, then on March 1 pays a sum equal to March rent, you apply the sum to the February water charge first and then to the March rent and you post a pay or quit notice for the unpaid portion of the March rent. If it goes unpaid within the p/q period, evict. You don't want to be chasing your money down the hard way month after month.

I would follow OK-LL advice. You don't want someone who doesn't pay the water bill and is doing things to your property without permission. That's a bad sign. You may not even know what the home looks like inside anymore. Follow the law, and get this tenant gone.
