All 50 States have adopted the International Building Codes including Washington DC. Within these codes are the requirements for operable windows. When the landlord has windows that don't open, it is often a sign of poor maintenance or lack there of.

The last I knew, the IBC only applied to new construction and remodeling. Property Maintenance codes apply to rentals and not every place has adopted them.
