You'll find the answer in your rental agreement. If your agreement was reduced rent, but in the case of breach of lease the rent would default to the original higher rent, then you can charge the higher rent if they are breaching the rental agreement by leaving early. If they are terminating a M2M or are at the end of a lease, then no you cannot ding their SD for additional rent over and above the amount you agreed to. If that were the case, why couldn't we all just say to all of our tenants, "I've decided the rent was higher than we agreed and I'm keeping your SD to cover it."
