I don't know for sure, but my guess is that in Judge Judy's court, the FB post would be admissible... make sure you take a screen shot of the FB page and the date etc just in case.

As for a suggestion about contacting your tenant on FB about this, well, that gives him a heads up that you check on him, and he may privatize his pages and then you'd never know stuff!

If he is extremely negligent in his treatment of the property, have you served him with any notices to Cure or Quit or ??

Is his negligence anything that would merit a termination of his lease?

I agree that people tend to confabulate and exaggerate on FB, so what was likely a minor issue became more *exciting* when he posted about it. Go figure.

I saved the entire FB post with its 129 comments to PDF, timestamped.

Exactly my thoughts on checking in with the tenant about anything posted on FB or Twitter. I don't want him to put everything to private. I also suspect he exaggerated the "water pouring down" issue as he and his family are a bit on the drama side.

Yes, he and his wife (both signed lease parties) have had several Cure or Quit notices. He will "cure" items just long enough for me to check on it and anytime that he knows I am coming over for something. I've driven by the property unannounced on several random occasions without going inside and noticed the outside violations where he goes back to the negligent ways because he doesn't think he's being caught.

I don't know if any of it singularly would merit termination of the lease but combined it is complete disrespect for me and the lease by he and his wife.

Some Examples (Not Nearly the Whole List):
*Drove over a buried drainage pipe in the yard that runs parallel to the driveway, thus cracking/smashing it (tenant and family have 2 large vehicles and a hobby car; there's a 2 car garage and driveway); In the process of getting estimates for replacement and it will require digging up at least 10 feet of the yard; Has been warned in writing not to drive over it; He parks 1 car in the street when he knows I'm coming but continues to drive over the pipe daily when he thinks I don't know

*All 4 appliances provided/maintained by the landlord, which were inspected and in good working order per licensed technicians prior to move in, have "broken" during this lease and been replaced with new ones (Coincidence how they mentioned the appliance color during walk through; said they'd live with it)

*The new deadbolt on the front door "broke" the day he moved in as well as the master shower fixtures, requiring replacement; The back door to the garage "broke" 2 months later; The back door to the yard has been heavily scratched by their huge dog (pet fee is not going to cover it as it's a french door setup)

*During periodic inspection, multiple rooms have dents/holes/gouges in the walls and/or doors from them moving furniture or roughhousing or who-knows-what

*He's asked repeatedly if he can do repairs himself to what they have damaged when it states in the lease no repairs, alteration, etc; Always reiterate "no"...

There's no real one issue that can serve as a reason to terminate but I'm keeping detailed logs for when the lease ends.

      I have PITA who have continually violated the lease. Family was friendly with before renting. Since then T deleted every family member from friend list. However it is easy to figure out what is going on by other mutual friends of theirs. This is how we found out all of the violations that were occuring. I did screen shots of everything in case I need them. I think they will hold up in court if they are screen shots of FB. The PITA thinks he is smarter than everyone but in reality he will be screwed if we end up in court:)
