I posted about this problem a while ago and I'm so mad I am having trouble letting this go. A 5 year T (clean but never on time) emailed me that he has gotten a second flat tire from screws in the gravel driveway and wants us to pay him $300 for the cost of the new tires. He said it is my responsibility to keep the driveway safe. He KNOWS the screws are from the tenant who rents the garage at the mouth of the driveway because, he claims, he keeps finding screws in front of the garage door. Also, he ruined his tires because he drove on the rims for too long. I rented a magnet sweeper and found TWO screws in the gravel both near a bush, far from the garage door. My hubby spoke to the T and said he would pay half ($150) and the T said he'd think about it. This T has always been nice and I can see where he'd be mad about the cost of the flats but I feel taken advantage of. There is no certainty that he got the flats from our driveway. When I get flats from screws/nails/rocks I don't drive on the flat tires until they're ruined then call the town and say, "it's your responsibility to keep the roads safe, I want you to pay for my new tires!" Do I now have to buy a magnet sweeper and go over the driveway once a week??? Plus this is a first in 10 years! UGH! $150 is a whole day's pay for me at work.

Here is how you should have responded.

I am not paying for your tires. Do you want to move out this week? It is crazy for your husband to offer to pay half on the tires. When the tenant gets back with you about allowing you to pay for his tires, tell him you are not paying and have decided he needs to move out now before he has any more flats. All tenants have a shelf life. Yours has reached the expiration date. Again, do not allow this nut to get into your pocket.

The tenant said he's think about it? How dismissing of you & your husband's offer to pay half!

How frustrating!!! If I was in your position, I would re-think keeping this tenant because he is now causing you grief and money AND while he may be clean, you noted that he is never on time with his rent. I think you may be opening a huge can of worms with this tenant and down the road, he may be making more demands for who knows what! So what if he's always been nice--he never pays his rent on time, and now is causing your grief.

Maybe an idea would be to have the fellow with the garage rental be responsible for getting a magnet sweeper and using it, and if there are any problems with flat tires, the garage renter would be on the hook for this. Not sure if you could even do this, because there is a problem of actual proof that the thing that caused the hole in the tire unquestioningly came from the garage tenant...but you get the idea of what I mean, don't you? I'm sure others will have more takes on this and probably better info about problem solving.

You would have to weigh this with the benefits you believe you get from his tenancy.

Okay, I just read what Jake wrote and I agree!

After you tell the guy you reconsidered and were advised that you are under no obligation to pay for any part of the tires -- since nothing can be proved where the screws or nails came from--but you understand how frustrated he is and so you will be generously giving him the opportunity to get out of his lease early without penalty if he leaves the place broom-clean and is out by the end of April.

I think I would tell the tenant he is free to move at any time.

How much are we responsible for in the parking lot? Years ago one tenant's car hit another's car and I guess they handled it through their insurance companies. But what am I responsible for?

This tenant is screwing you. You can get tires plugged for $20 a piece.
If you've already paid this guy, raise the rent $50 a month for this stunt. Then give him a nonrenew once you've recouped the $150 If he leaves o well. You sound mad(as you should be). And this will give you piece of mind as well.

If you are indeed responsible for the tires, you are only responsible for the DEPRECIATED value of the tires he had on the vehicle. Even when you buy new tires and get the protection plan, they prorate the value after a set amount of time/mileage. If he was riding around on two year old tires that had the treads worn down or he never bothered maintaining the air pressure in them and rode them half flat which causes additional wear/damage, then that is what he is entitled to from you. Take a gander on craigslist or ebay. Some advertised as in good condition are selling for $25 each.
