Force removal of mobile home from park

I purchased 5 mobile homes that are in a mobile home park. Three of the mobile homes are currently rented and the tenants have been paying lot space rent to the mobile home park owner on time and have caused no problems. I am selling the three mobile homes to the current tenants. They have been told that they must move the mobile homes out of the park. Two of the mobile homes need fixing up to rent and I have tenants that wish to move in as soon as I make repairs. The mobile home park owner says that I must move the mobile homes out of the park. Can the mobile home park owner do this? The mobile home park owner says that I can not rent mobile homes that are currently in his park even though I pay lot space rent on time. Is it illegal to buy a mobile home in a mobile home park and then rent it out if the tenants meet all of the mobile home park requirements to be a tenant? The mobile home park owner is upset because I purchased the mobile homes from the previous owner and he wanted to buy them himself. Would appreciate any advice on this matter. Thank you all...

Yes he can. Eventually all of your mobile homes will be evicted from the mobile home park. The problem is that you do not have a lease with the mobile home park owner. It is also unlikely the current lot renters have one. But even with leases, they will not be renewed and all will have to move sooner or later. If there are no leases, it will be sooner. Start looking for a place for all the homes to go. You can not win this one.

While there are some similarities between mobile home parks and LL/T law, In some state's, such as mine, they are covered under separate sections of a state's statutes. A quick google shows this to be the case in NM also.You should familiarize yourself with chapter 47 of the NM code or find a lawyer experienced with that area.

How would you see it being otherwise? Do you believe you should be able to stay in a mobile park without the consent of the owner, just because you pay on time? As a LL, would you allow your tenant to call the shots, even so far as staying in your rental against your wishes? Would you allow your tenants to stay forever just because they pay on time, regardless of your plan for the property, your financial needs, or even your attitude? Put yourself in the mobile park LL's shoes and the answer to your question should be clear.

Yes, he can do this. It comes down to who owns the property. Not who owns the trailer. Is there another mobile home park you would be interested in relocating the trailers to?
