Nonpayment of rent by Laura (Missouri) on April 3, 2012 @08:31

                              
We have a tenant who has not paid rent since January. They indicated they would pay Feburuary with March rent and we agreed. When March rent was past due, they indicated they would pay March 15. That day came and went and they said they would pay one week later. We sent a letter on March 23 (return receipt requested) and notified them they needed to pay or we would begin eviction processes. We found out they were moving out on April 1st. On March 30th, they told us they would move out on April 6th and that they still plan to pay. What is our next step with them? We are incorporated. Totally unrelated to non payment, I saw them take two dogs out of their apartment the toher day - which is prohibited in the lease. I told them to get rid of the dogs by the next day. I have now learned that two other tenants have pets (one a dog and one a cat). Any thoughts on what to do with them? Send them a letter? Thank you very much.

Quit agreeing to let them slide. They obviously cannot be trusted. Evict.

It seem that you are not prepared to be a landlord! You have no idea what you are doing or what needs to be done. Find an attorney they can help you with the non payment tenant. Then get a copy of your State Landlord/Tenant laws and learn them. As to the pets, issue a 'cure notice' to tenants that they are in violation of the lease for having pets.

Please let me apologise for the rude responses from the tenants who post here who are not really landlords. You are a little in over your heads. Seek out a lawyer who has experience in handling evictions. Make careful note of what action he takes. Next time you will be able to do it yourself. There is no limit to the ways a tenant will abuse you. A real leaning experience awaits you. Use the lease provided here. Screen your next applicants with a credit and criminal background check. Even when I agree to a late payment, I always post the p/q notice on the 2nd, just to preserve my right to evict for the current non-payment (and I explain that to the tenant, so it doesn't discourage them from paying per plan). That way, if the payment plan falls through (and they do about 90% of the time), I'm still on track to get the deadbeats out ASAP. This way, you would have filed the eviction suit on the 16th and they'd be out by now. At this point, they have figured out that you will swallow any story they present and they can stay in your unit for free until you wise up (they don't have a very high opinion of you--how did that develop?). If your lease agreement includes any provision for a violation penalty in regard to pets, you would attached that penalty to their rental account and file for the whole amount owed.
