Several years ago my tenant tried to use the same excuse to break my lease. And in a way they were successful. Cost me $250.00 for a new window and several months lost rent.

Turns out the tenant family had a teenage son that ran with some undesirables. I believe the undesirables were responsible for the break in. Or it could have been the empty full color wide screen HD TV box that sat on the curb for trash pick up that advertised "free LCD tv", come take me.

At any rate she broke the lease and left with 11 months to go. I re-rented in a few months and kept the SD for damages.
