You can do an amendment to the lease transferring the responsibility from the current tenant to the new tenant but both the new and the old tenant have to sign it. From the scenario you described, this is just the beginning of your troubles with these people.

So what do I do if he does not agree to sign it? He has left but is apparently still coming back and bothering her.

Stay out of it. Let the court settle it for you. Last thing you need is to be named in the suit along with him or her.
