My tenant was the previous home owner and a friend, I bought the house from him and he continued to live there on a verbal M2M because he claimed moving to another state within 6 mos. Instead he lost his job before he could move and 4 years later he is still there, paying me what the mortgage was at the time. He's been a decent tenant until recently with late rent and then trying to pay less rent and not taking care of the yard, so I feel the need to move him to a written M2M to clarify our responsibilities to each other. He is currently living there, how do I present this new lease to him? I know GA requires 60 days to changes in an at will tenancy. How do I inform him that the agreement must be signed within 60 days or he needs to vacate? He does not do well with change. He is not poor despite long term unemployment and my written agreement is more than fair to him.

In my state, I owuld need to give 30 days notice. I have done this with long term tenants that had carry over verbal agreements from a previous owner.

Send a letter terminating your current rental agreement. Then state that a new one will be offered commencing on whatever date would be when the old one ends. If he does not sign the new one? I guess you would move to have him kicked out....nto sure on that area. I would call or talk to him prior to sending the termination letter and your intentions with it, so it does not shock him when he gets it.

You really do not need a new lease to get the point across that you want to be paid in full and on time. Nothing says pay on time like a Pay or Quit notice. Call next time your tenant is late and tell him you are going to start leaving a reminder on his door when the rent is due. Then post your P/Q notice. Also tell your tenant you have been thinking about hiring a lawn service for his place but you will need an increase in rent to cover it. Every tenant has a shelf life. Your tenant sounds like he is past the expiration date. There is nothing wrong with your current lease. If your tenant needs to be reminded of his obligation to pay in full and on time he can read it from the P/Q notice you will nail to his door.
