' they are considered "At Will" tenants' You are correct as Georgia views no lease as a 'Tenant at Will' situation. You must give 60 day notice to terminate the lease. This will be the fastest and surest way to remove the tenants. As to 'Entry', post a 24 hour notice to tenant. You are entering to inspect the apartment for damage and needed repairs, not to search for marijuana use. Sent the tenants a 'Cure notice' as to the reported smell of marijuana, with notation of your rules and regulations about drugs. Is this a 'No Smoking' rental unit? It will take you longer then 60 days to evict for suspected drugs activity then just ending the lease in 60 days. If you intend on keeping these tenants, then get a 'Signed Lease' with additional deposit, a strong worded lease addendum about the drug activity being grounds for termination of the lease.
