First, each and every payment the tenant makes is applied to the OLDEST bill first. So.. paying May before paying off March and April is just not possible.
Next... as Jake is always saying...no pay is the path to no pay. I suggest you serve the tenant with the pay or quit notice right now. And follow up with an eviction.
In the future...never let the tenant get behind on the rent. When the rent is first past due, serve the quit or pay immediately. This is what you should have done on March 2nd.
Next.. even once you get a judgement against the tenant..in most States the only thing you will ever get is the knowledge that you have messed up their credit rating...then again, they probably already have bad credit.
Get rid of this tenant. Establish standards and credit rating required and only rent to qualified tenants. If you find it is hard to rent to well qualified tenants..then lower your rent...never lower your standards...because you will end up losing a lot of rent.

Same tenant with rubber check and no funds gave me a written note stating he would move out if he did not catch up by April 15th, well he didn't. Give me your opinion on that aspect of this case.
If i can nail him on fraud or writing bad checks, I would rather that to dangle over his head but of course, rather have him vacate ASAP.

Issue the proper notices as your state indicates. Pay or quit and a notice to move out within the state requirements. The file for eviction.
Dangling his bounced check in front of your tenant is not really going to accomplish anything. He is already staying there for free and knowingly gave you a check that never had funds in there. I doubt he is going to care that you tell someone about it. You have the option to contact the local police department from where the check was issued and file a report and paperwork, but that doesn't mean the police are going to get your money or even haul him into jail.
