I Have a M2M rental, It is stated in the lease the tenant is responsible for attorneys fees, But apparently this was not good enough a judge in LT court , I want too do a addendum , making sure the tenant has to pay attorney fees and also late fees so they cant be excluded at time of eviction court.

You may purchase the LPA lease that will cover this for your state. The link is to the right of the screen under "Essential Forms." You are able to tweak the LPA lease agreement and make it a month to month rental agreement.

I have seen Judges exclude just about everything regardless of if it was legal or not.

I have had to appeal bad decisions on several occasions.

I doubt you will ever be certain that a judge isn't going to exclude whatever. Only thing you can do it take it to small claims and get the judgement there...and/or appeal the decision.

Some judges just seem to think that landlords are all rolling in money and should contribute their income to the tenants.

I just realized something that may be true.

If your lease says the tenant pays attorney fee and you hire an attorney to write them a letter due to certain violoation of the lease, or maybe their lack of response, you might and could charge them for the attorney fee.

Your posts made me consider this. For example a situation where it does not go to court you can still charge the tenant for the attorney as it is in the contract?
