How do you figure #19 has never been occupied by the lease signers? You said on the last day of school in 2011 they moved from #19 to #21, so they must have occupied first #19, then #21. You also say they stayed in #21 rather than move back to #19. Why don't you just amend the lease to reflect the correct #21? And no, the tenants relocated for the LLs convenience, so you cannot now use that circumstance to tenant's detriment.

I'm sorry. I wasn't clear. The students signed a lease for apt #19 in October 2010 for August 2011 through August 2012. The students moved out of Apt #19 in May 2011, during the first year's lease, which wasn't up until August, at the management's request. They never moved back into Apt #19. They have been living in apt 21 this entire school year. Can the lease be broken since the apt # is not accurate?

    BTW, you still haven't clearly explained the situation. I think what you are trying to say is that you had existing tenants in #19 whose lease was up in August 2011. They signed up for a second year (August 2011-August 2012) in October 2010 midway through their first year lease. In May 2011 LL moved tenants from #19 to #21 for LL's convenience and for some reason, LL now wants tenants out and is trying to use a technicality to oust tenant. Unfortunately, push comes to shove, the tenants will argue in court that LL and tenant had an agreement to use #21 instead of #19, evidenced by LL collecting tenants rent on #21 all this time, which supports tenant's argument. Why can't you just move them along for a real lease violation instead of this backdoor approach?
