Hi, OK-LL

The couple hasn't paid rent in almost six months. My brother hired an attorney and they went to court a couple of weeks ago. Before going up in front of the judge, the couple decided to sign a "Consent to Enter Judgement for Possession (Tenant Vacates) and they were given ten days to be out which was this past Tuesday. My brother said they haven't moved out yet, so I told him to call the lawyer and get them removed! My brother also told me that the tenants that live below, complained of banging on the walls. They told my brother, they believe the couple is destroying the apartment. Because I am out state and working long hours, my brother is handling this for me. Any advice or help I would apppreciate. Is there anything I can do if this couple trashes the apartment? and is a removal the quickest way to get them evicted? thanks again

Your brother needs to contact the county sheriff and have him come out and physically evict them. He should have gone on Wednesday because this can take up to 2 weeks for the sheriff to process the request and actually go out to the rental unit.

If the couple trashes the apartment, you will have to sue them in small claims court for the cost of the repairs...that is if you can find them once they leave to be able to serve them and they have some kind of assets you can go after.

Any particular reason why you waited 6 months of non payment before filing for eviction?

civil court for all destruction
take pictures of damages
sue
ruin them completely
ruin their credit
ruin their rental-with eveiction
destroy them with civil monetary awarding
puruse to the fullest extent of the law
destroy them
make them homless

    Lindsay..I admire your hart heart:) what is civil monetary awarding? By the way...if tenant destroy intentionally your property...doing all of the Lindsay's list will not bring money fast any way...the better way is to make a claim on insurance(act of vandalism should be one of the perils on your landlord policy}...and than sue them for deductible and the raise of the insurance if any ...and than do what Lindsay said:)If you have potential tenant who signed a lease and has to wait till you fix apartment-insurance has to pay for lost of income too.
