I bought a building with M2M tenants in it who were paying about 60% of FMV. I sent them a renewal of lease/rent increase letter. THEN I realized that I never got an app on them from prior owner so I emailed them to NOT sign the new lease until I sent out the apps for them to fill out. They returned the apps... H is unemployed. W makes $800/month on disability. The rent is $600/mo (includes all utilities). I wrote them back using the LPA non-renewal of lease letter and added a paragraph about WHY I was not renewing them. It stated something like, my criteria is that your rent must not be more than 33% of your take home income and so you do not qualify to rent this apartment... then the rest of the LPA form... great form, BTW.
Was it ok to tell them why they didn't qualify? Is there such a thing as income discrimination?

It would probably have been better not to provide a reason for the non-renewal. What are you going to do when they sign the lease you sent them?

No, however there may be state laws governing present tenants, aka rent control.
