I have a rental and a potential renter told me he has a medical marijuana card and wants to grow it. I have no problem with that, but want to know if there is a clause I can put in the lease that protects us from illegal search and seizure of my property or any other bad thing that could happen? Logically, I am leaning toward a standard "no smoking" in the house. Just to make matters a little more complicated, he says he also has a biodeisel setup that he wants to use. I would appreciate some feedback while I research this. Thanks!

While some states allow the use medical MJ under strictly defined circumstances (is NM one of them?), it is still a violation federal law.

Be glad he was upfront with you, and find some LEGAL reason to pass on him being your tenant.

You are in for a world of hurt because federal law trumps state every time. You do not want to be the test case for this.

If he has a medical marijuana card, you can bet he has friends who are an active part of that culture as well.

In case you missed it the first time, FEDERAL LAW TRUMPS STATE LAW EVERY TIME.

Please search this forum for all the horror stories of tenants growing marijuana. You run very high risk of tenant not paying the rent and completely trashing your place.

Hi Shelly - look him up on the NM Courts web site. Does he have a criminal history.? While it is legal to use medical marijuana, I believe the state is regulating suppliers (growers)... If you are in ABQ there is an apartment assoc. that may be able to answer a question or two. Or just talk to an attorney.

We seem to have more than our share of "unusual characters" . Check on the biodiesel deal. If he is using old cooking grease (or other nasty Bio material) he may make a big mess in the garage, yard, or God forbid, the kitchen!!

I agree that this guy sounds like quite a bit of trouble unless you are desparate to rent your place.

"Because I'm depressed."

"Why are you depressed?"

"Because I don't have any marijuana..."

Tah-duh-bump. :)

Meanwhile - every seen what the humidity of a grow room does to drywall and everything else?

Just say NO to medical marijuana. They can buy it at their local pot head store, er I mean medical dope dispensary.

The answer is simple: Abosultely not. Not just because it's marijuana, but gardening in general. In general it's wise to avoid special circumstances. Once a long time ago, unbenounced to me, my tenants grew tomatoes and squash in the river rock the went around the perimeter of the home. They turned the sprinkler on one weekend and left town. It cost me a fortune and a ton of agony to fix the water damage that resulted, and to cleanup/repair a flooded basement.

Then there is the break in and murder of the tenant to consider because he was growing weed...
