Won't I be in trouble by the Judge because I didn't send the statement certified? As you can see I am a bit nervous. I have never been in any legal trouble...

In NJ, for non-payment, you may file for eviction immediately.

Do you recall when you sent the statement? Do you have it referenced within your documents or kept a copy of what you sent? If you do, then you can respond to your tenant via certified written notice that you issued them the information on such and such date and sent via first class mail, etc.

Take a look at the Truth and Lending brochure issued by state government. Page 9 deals with security deposits and when and if you have to report interest earned, bank location, etc. if your rental is an owner occupied two or three family home, the law differs, unless the tenant chooses to invoke it by giving you written notice and 30 days to comply.

    Thank you very much! But he said he is invoking his rights per Truth in Lending charging me 7% because he says I failed to tell him where his money is and the interest he was getting...

      Marg, what type of residence is it? Is it a single family home or an apartment in a multifamily home you are also living in?
