This is in response to the reply's on the original post above, which I posted. The tenant in question has not been living in bad condtions for 7 months. The jack hammering mentioned was done in 2008 and everything was put back in proper place. Carpet was only 2 yrs old and in good condition after repair work done in 2008. The bathroom leak only occured 2 months ago and we were tring to fix the problem without tearing out the bathroom wall. we removwed his toilet and hopefully have the bathroom overflow fixed.The samll mildew spot on the ceiling over the shower we found was due to a leak in the apartment above which is now fixed. It is not mold and his bathroom is not uninhabitable. If it takes longer than a day to repair his wall in the bathroom, we will put him up in a motel.
His apartment is not unfit to live in. I think you totally misunderstood that fact. The statement he made about the leak in the bathroom overflowing in to the living room is very questionable. It was never turned in or reported to the office. We will probably have th3e carpet cleaned ourselves, but he needs to clean up his kitchen, which is alniost 1/2 inch thick in grease in almost every area. This is not due to anything we did or pertaining to a leak anywhere. All I am asking of him is to please clean his kitchen area and we will probbably clean his carpet. I do not want to ask him to leave, his repairs are in process and all we expectof him is to clean up his kitchen as we would expect from any other tenant we should find with their kitchen in this condition.

If the kitchen is covered in grease, send him the proper notices according to your state. Wait the required period and perform an inspection. If it has not been corrected, send the next set of noticed required. In your notices, cite it is a fire and health hazard and will need to be reported to the proper town authorities such as Fire Inspector and Health Department as will can lead up to a motion for eviction. If he doesn't clean up, you will have to file for eviction because you cannot make him clean up if he doesn't want to. Or your other option is to wait for him to move and charge him against the security deposit for excessive cleaning fees and any other damamges

If the carpet was two years old back in 2008, you should just replace the carpet as it is at it's useful end. Two months is way too long for repairs to be completed. Insisting that the tenant clean his kitchen before you clean his carpet is a failure by you to complete repairs. The cleaning/replacement of the carpet has nothing to do with the tenant's dirty kitchen. You seem to down play the tenants concerns and over state yours (1/2 inch of grease in almost every area of kitchen). You may only inspect for maintenance and repairs under State law and not just for cleanliness alone.
