My tenant wants to move out after one month by Ana (CT) on May 8, 2012 @19:47

                              
I rented out my house a month ago and I have a signed for 1 year starting April 1. This was through an agent, so I paid 1 month rent as a commission. Today the tenant called and said that they can't afford the house. They didn't pay the May rent.
Anybody has dealt with this kind of situation?

You should have ask a month ago. Post a pay or quit notice on your tenant's door and mail another by certified mail. The term of a pay or quit notice varies from state to state. It is 3 days for many. Check your state law on the internet. The minute the pay or quit period expires, file for an eviction. You need to do this before your tenant moves out and disappears. If your tenant moves out after you have filed and she is served, you must continue with the action. It is the only chance you have to get back your lost rent. Post the notice in the morning, first thing.

When dealing with an agent, never pay up front, only at the end of a 1 yr lease, they are more likely to find a better long term tenant then. That or space the payment out m2m percentage-wise and make sure there is a clause about proper payments and not defaulting on the lease...

These realtors act like cellphone salespeople...

I wouldn't fight them on moving out that's for sure because you will only lose more money in the end. Like others said post a pay or quit notice and then file for eviction. Let them know you will file for eviction if they do not pay up and that it will ruin their credit and make it very difficult to ever rent a decent place again. If they do pay up but still want to leave let them. What kind of stipulations did you have with your agent when finding a new renter? Have all your stipulation down on paper and that they are liable if they rent to someone without those qualifications. If possible do it yourself. They just want someone in quick and with the minimum of work so they get paid.

I suppose you should restrict at first that there is specified period of time of rent a house. I always do that when I want to rent my flat. IN my situation such period is minimum 6 months. But it is only the flat.
