So here's the situation.

This weekend the male tenant at one of my properties was arrested. According to his girlfriend, who is the other tenant, he was mad at her, they argued, she attempted to leave, and he went in the house and got a gun. She called the police and the police arrested him. This all occurred at 2 am after he had been drinking all day while she was at work. Last time I spoke with her, she said she was going to get a restraining order against him. As far as I know, this has not been done. He just got out of jail yesterday. He called and told me his version of events. He also believes that he's going to be living back at the property. He claims the charges will be dropped because his rights were restored. He also claims he was only arrested for the one charge -- possession of a firearm by a felon. So far, everything he has told me does not make sense. I haven't checked his story out with the police department yet, but my past legal experience tells me this is BS.

I'm pretty sure how I'm going to handle this, but wanted to know what some of you other LLs thought.

Stop listening to whatever their problems are. Change the subject to just who is going to pay the rent. You are not the referee of their domestic troubles. The first minute the rent is not paid, post a Pay or Quit notice on the door followed by a certified letter to each of your tenants with a copy. The first minute the Pay or Quit notice expires per your state law, file for an eviction. It does not matter that one of them may not be on the lease. Evict your lease holder "and all others." If both are on the lease and one will be staying and paying, say no when you are ask if the other can be removed from the lease. Here is the reason why. Because a couple of weeks later the one that was removed will be back living in the rental. Because you know, they are in love.

The possession of an illegal firearm by a convicted felon is at issues. Any illegal activity or use of the premises is a lease violation. Time to initiate the eviction process.
