are you saying if the tenant gave you $1000 security deposit and leaves the place Merry Maids sparkling but has failed to pay rent, you can't keep the security deposit towards the back rent?

I can use the deposit for rent and/or damages.

In California, you can apply the SD to unpaid rents.

If, after assessing damages, unpaid rents, etc. the SD does not fully cover outstanding amounts, you would then issue a demand letter to the tenant and if no satisfactory outcome, take them to small claims court.

    This is why one should post the p/q on day 2 and file for eviction at the end of the p/q period. Even this close to a move-out. Now the LL is stuck using some of the SD on the rent, instead of getting her rental repaired, and she's gotta hope to find the tenant now she's moved out in order to serve for a money judgment on the damage.

      Exactly, my answer was to the person who said you can't use SD for rent owed.

      But I agree. It is not the best scenario especially when other damages need to be repaired.
