The property probably is considered abandoned depending on that particular state's law. the tenant being in jail would be one factor. If the landlord regained possession because of abandonment, the ll had every right to start cleaning to rent the unit. The LL needs not wait forever. I usually ask the police to accompany me to determine if a unit has been abandoned. Much safer for LL.
