I'm thinking about working w/ my tenant to allow her to catch up & get current w/ rent & other costs. This will involve setting up a schedule of payments over the course of 3 months. Since I would be ageeing to these payments ahead of time, can I still charge late fees during this time period?

What's the point? She got into arrears because she couldn't pay, so now you think she can pay what she couldn't pay before, plus some, plus LF? Not bloody likely. Cut her loose and find a better tenant while we're still in a good season to do so.

Don't bother trying to let her catch up. 97% of all bankruptcies fail because the debtor couldn't make the original payment much less the payment plus the arrears. Cut her loose while people are out looking.

Good luck with this. It's likely you'll never see your money. Suuurre the tenant will sign something, but you 99.99% probably won't see your dough.

Unless the tenants circumstances have changed and she now has much more income what makes you think she'll be able to pay the current and past rent? Maybe if she's just gotten a new job after a period of unemployment you might get some money, but it probably wont even be as much as the current rent, never mind catching up.
