Right to a room or can I kick them to the couch by dee (pa) on May 25, 2012 @06:35

I have a roomate who owes me for half months rent. I don't even want to collect it at this point, I just want to provide an eviction notice, in our state it is 10 days if behind on rent. For the next ten days am I obligated to allow him to sit in the room or can I make him take all his stuff out of that room and sleep on the couch until he goes elsewhere?

Im not really worried about being sued over this should i in fact do this, but I wonder what your thoughts are. thanks.

Do not take any of his stuff anywhere, do not move anything, do not touch any of his belongings, and any communication you two should have, have it in writing.
When was rent due? It is 10 days PAY OR QUIT notice, meaning, if he comes up with the money in 10 days, you do not have to evict him, if he does NOT come up with the money for 10 days, you need to file for an eviction in court.
I am confused about your situation though, are you the actual Landlord? Or do you just have a room mate agreement and are both tenants??

"Im not really worried about being sued"

If you are not worried about being sued now, you will be when you are standing in front of a judge.

I know that in New York and Massachusetts you must be the owner of the property or the licensed agent of the owner before you can file for an eviction in court.

Without the eviction order from a judge, DO NOT MOVE ANYTHING belonging to this person.

If you are not the owner...then go talk to your landlord
