Yes, proceed with the eviction. You have already spent the money for filing and court cost. The tenant will not show and you will win. Winning the eviction will wreck the tenant's credit for good. It will remain a permanent part of his credit for life. He will never again be able to rent a decent place or make major purchases like a car or house that require good credit. Ask for damages and see if your state will allow for the garnishment of wages. If your state does not allow for garnishment, a tenant will often offer to "settle" at a later date when he discovers the damage you have done to his credit. Say no to a an amount less than the damages unless you want to be victimized twice.

But you should go ahead and show up in court. If the judge ask if your tenant is out, you can say you are not sure. Probably you should not make an entry until after the court date. If you tell the judge the tenant is out he may tell you that you do not need an eviction since you already have possession. The whole idea is to wreck the tenant's credit with an eviction and get a judgement.

Jake, Thanks for your imput however I've seen courts take the position of the mail eviction letter being returned undeliverable and The Magistrate dismising the case. These tenants know how to work the system. This individual is a military person that pending a medical discharge. I reported it to his command at first they instructed him to pay and return the phone calls, but then recended their position when the tenant/military member failed to follow their instructions. The tenant has left the property without paying his rent with property damage. Thank you four thougths Rob
