You may not be able to prevent it, but it doesn't really matter, Dum Dum. If they claim they already paid you, they were still in breach of the lease if they were late beyond the 3 day(or however long) pay-or-quit.
Go learn the law, then you won't have to ask us dumb hypotheticals!
And yes, whatever the bank says....is legal. So don't question it. Dum Dum.

Very Professional response to a good question! The fact is in many States , the acceptance of a partcial payment voids any action to evict. Perhaps it's you who should be more understanding and also more versed in the many State Landlord/Tenant laws before you prove who is really "Dum Dum".

If they BREACH THE LEASE, they are in BREACH. PERIOD. Doesn't matter if you accept partial payment or not. They could pay you 3 months' rent up front! You can still evict for breach of lease.
Now, after the eviction, if they can prove they paid you, then they can file a claim for whatever you owe them. But eviction generally follows from a breach of the lease. Period. At least that's how it works where I live.
