The important thing is that the person is out. And truthfully, you are more likely not to collect from this tenant, regardless of what many will tell you.

And "needing that money to pay your mortgage" is a sign you are in over your head. You should not be a landlord if you cannot handle missing a month's payment.

You need to do some basic research, not ask people to spend 30 minutes teaching you what a simple search on this site or internet would tell you. Go lease the small claims process. Get a lawyer, especially for your first case.
