One of our tenants died in Oct. and her brother still has not removed all her things from the apartment, which was fine while they were still paying rent. It's been 2 full months now, June being the 3rd that they have not paid rent. We have tried calling them with not answer. So who would own the stuff in the apartment? Can we sell it in order to get the back rent? And how long do you think we should wait.

Put everything into a storage rental. Pay one month and write a certified letter telling the brother where it is. You have already waited two months too long now. If your state allows it, you can seize the property for rent due but make sure you follow the state law or relatives will come back on you for the value of their family heirlooms. If you have not already changed the locks, do it now.

Remove the stuff, amd proceed forward in getting the apt rerented.
The executor of her estate owns the stuff at this point. I would not sell the stuff until you get the okay from the executor that the stuff is not wanted.
Wait to sell the stuff, according to your state law on abandoned property. Your state law probably considers the stuff abandoned at this point, though.
